These are our general terms and conditions for walkandmeditate.com holidays

Please make sure that you read this section as these are the conditions that you agree to when you book.

Booking Conditions

1 – No contract shall exist until the signed booking form together with the appropriate deposit, or the full amount if the booking is made within 90 days of the begining of the retreat and a confirmation invoice has been issued. Persons making payments without completing the booking form will be bound by walkandmeditate.com’s booking conditions. Where a booking is made on behalf of several individuals the booking is conditional on the person signing the booking form having authorisation from all the individuals named on the booking form to enter into this contract.

2 – Walkandmeditate.com reserves the right to decline any booking at their discretion.

3 – The contract is subject to these booking conditions which the client has been deemed to have read and fully understood. These booking conditions can only be varied by written agreement between walkandmeditate.com and the client.

4 – The contract may be assigned by the client to a third party subject at all times to conditions.The client is unable to assign or transfer the contract to a third party without the prior written consent of walkandmeditate.com, if the client wishes to assign their contract, he or she must give notice in writing providing the full name, address and contact details of the third party. Walkandmeditate.com shall then advise in writing as to if it consents to the assignment as soon as is reasonably possible. Walkandmeditate.com reserve the right to refuse an assignment to a third party at any time and without reason, If subsequently a client has to cancel due to walkandmeditate.com refusing the assignment to a third party then the cancellation charges under cancellation by the client shall apply.

Deposit and payment terms

1 – The customer shall pay walkandmeditate.com a deposit of 700€ (or 750$ or 600£) due for each person named in the reservation.

2 – Hold deposit is non-refundable.

3 – Full payment of the balance due must be made 90 days before the begining of the retreat or walkandmeditate.com reserve the right to cancel the arrangements made on your behalf and charge the applicable cancellation charges.

Cancellation policy

1 – Please note that because walkandmeditate.com retreats are limited to a small number of attendees, to allow for a more personable, intimate experience, our cancellation policy is in place to help guests and us alike work together sharing expenses that may arise from unexpected cancellations.

2 – Cancellation of your holiday, for whatever reason, should be notified to walkandmeditate.com in writing.

3 – If you cancel your booking after you have paid in full the following cancellation charges will be made:

. 90 days or more before the begining of the retreat : Loss of deposit

. between 76 and 89 days before the begining of the retreat: 30% of total price

. between 61 and 75 days before the begining of the retreat: 50% of total price

. between 31 and 60 days before the begining of the retreat: 75% of total price

. 30 days or less (or fail to join the holiday) before the begining of the retreat: 100% of total price

These dates refer to our receiving written notification of your cancellation.

Extra costs incurred by guests while at the retreat

1 – All spa and wellness treatments, additional meals, snacks etc will be charged as extras to the cost of the retreat.

2 – Failure of a guest to settle their account (extras) in full prior to departure and as set out by the retreat director will result in the guests credit card being charged for the appropriate amount, in addition an administration fee equal to 21% of the total unpaid bill will be added to the charge.

Definition of full board

The definition of full board will be 3 meals per day which will be provided as breakfast, lunch (or lunchbox) and dinner and on full retreat days only, on arrival day only welcome dinner will be provided and on departure day only breakfast will be provided as part of the retreat cost. This applies only to the retreats official arrival and departure days as specified in the published retreat dates for the appropriate year.

Airport transfers

1 – It may sometimes be necessary to combine, on certain transfers, customers arriving or departing on more than one flight, which may require additional waiting time at your airport or hotel. Sometimes our airport transfers are contracted to a specialist local agency. Please note departure times are 5 hours prior to your flight departure from the hotel.

2 – Airport transfers to/from Franz-Josef Strauss Munich airport are included in the full package.

3 – Our airport shuttle service aims to meet guests at Franz-Josef Strauss Munich airport between 13:00 and 15.00 on arrival day and arrive back at airport on final day for midday.

4 – If you can’t find flights to meet our service, we can arrange private transfer for you (at your own cost) or give advice on the local train service.

Passports, visas and health requirements

1 – It is the responsibility of all passengers, according to the type of passport you have, check with the consulate where the application for tourist visa is required.

2 – Due to visa regulations and health requirements it can change frequently, it is recommended that you check as soon as possible whether the application for tourist visas or health requirements is necessary.

3 – Walkandmeditate.com is not responsible if you or another passenger is traveling without proper health documentation and the correct passport or visa. In this case you should pay the costs of assistance to solve these problems.

Insurance

1 – It is a condition of booking holidays that all clients must have travel insurance to cover sickness, cancellation or curtailment.

2 – Before you come on the holiday you must be covered by insurance, which must include adequate cover for baggage, medical expenses and the cost of repatriation should you become too ill to continue, including helicopter rescue and air ambulance.

3 – It is up to each individual to ensure that their insurance is adequate for the holiday they have booked.

4 – If you join the holiday without insurance you may not be allowed to continue on the holiday, with no right of refund.

5 – Any claims concerning matters for which you are insured must be directed to your insurers.

6 – Your holiday package with us does NOT include travel insurance and it is your responsibility to ensure you have adequate insurance cover. In accordance with normal industry practice, we will require you to have adequate travel insurance to provide accident and medical cover before your holiday departs. Such insurance should ideally be valid from the date of booking, be valid throughout the holiday duration and financially cover any probable loss through cancellation, amendment, accident or health related problems.

7 – You should ensure you are covered for all activities you are planning on your trip.

Exclusions of liability

1 – Walkandmeditate.com do not accept any liability for: cancellations, delays or changes caused by war, threat of war, closure of airports, civil strife, terrorist activity, industrial action, natural disaster, technical problems to transport, staff cancellations or other events beyond our control; Participants’ medical or psychiatric conditions which may develop during or subsequent to the holiday; loss of, or damage to, personal property of participants.

2 – The client understands that attending any activity or service provided by walkandmeditate.com involves some level of risk. These risks include but are not limited to physical injury or even death. By attending any activity or service provided by walkandmeditate.com the client agrees to assume these risks and agrees to release and discharge walkandmeditate.com and its Directors, employees and agents from any and all claims for liability.

3 – Neither walkandmeditate.com nor any of its Directors, employees or agents will be liable for any loss or damage to any personal property or vehicle belonging to the client during the services.

4 – All guests must refrain from any illegal act or any conduct unbecoming a retreat guest, conduct or language which may give offence to a team member or guest or any act which may cause damage to property. If walkandmeditate.com or any of its staff, consultants or agents become aware of any such act / conduct then walkandmeditate.com and its agents may, at their absolute discretion, ask the client to leave the premises, property or facility, this will be without refund to the guest, in these circumstances walkandmeditate.com will have no further responsibility or liability to the guest.

Health

1 – It will be only your responsibility to consult a doctor to verify that you are in good health for the activities of the retreat.

2 – We request that you inform us if you have any health problems before booking your place in our retreat. If you do not inform us about your health problems, walkandmeditate.com holds the right to cancel your reservation and will not refund any compensation. If you have health problems that may be affected by the activities of the retreat, walkandmeditate.com reserves the right to advise not to participate in it, and could be denied participation if we believe there may be a risk for your physical or psychological health.

3 – It shall be the responsibility of women who are between 12 and 28 weeks of gestation, send a letter written by her doctor that says she is fit to travel and is capable of performing the activities we offer.

Complaints

1 – If there is a problem during the services, the client must report it in the first instance to the course manager / retreat director, if it is still unresolved then the issue should be reported immediately to the Director of walkandmeditate.com so that all efforts may be made to resolve the problem promptly and effectively.

2 – In the unlikely event that the problem can not be resolved and the client wishes to make a complaint then the client must notify walkandmeditate.com in writing within 7 days of the end of the services.

3 – Failure to provide notice of the complaint in accordance with the above will preclude the client from being entitled to take any further action against walkandmeditate.com.

Law and juridiction

1 – These terms and conditions shall be governed and construed in accordance with German law, and the parties shall submit to the non exclusive jurisdiction of the German Courts.

2 – This contract is governed by the laws of Germany. Any conflict between the terms and conditions of the contract and the law of Germany, then the law of the Germany shall prevail.

Changes to the terms

We reserve the right to modify these terms and conditions without notice.
